Terms of Service

1. The service

PermAd360 is an independent recruitment-advertising agency and SaaS platform. We provide PERM Labor Certification recruitment advertising services and a related SaaS workflow platform to immigration law firms, ad agencies, and sponsoring employers in the United States. By creating an account or placing an order, you ("Customer") agree to these Terms of Service.

2. Accounts

You are responsible for the activity that takes place under your account, for keeping your credentials confidential, and for notifying us promptly if you believe your account has been compromised.

3. Roles and authorization

The platform supports four roles: system administrator, ad-agency operator, attorney, and employer. Each role sees only the data its role is authorized for. Customers are responsible for ensuring that the people they invite to a case are authorized by them to see and act on that case.

4. Customer responsibilities

  • Provide accurate case information (employer, beneficiary, worksite, job title, SOC code, prevailing wage determination, and required recruitment steps).
  • Approve job descriptions and advertising copy before placement.
  • Approve quotes and pay invoices in accordance with the agreed schedule.
  • Respect intellectual-property rights in any content you upload.

5. Our responsibilities

  • Place the recruitment advertising you have authorized through the channels and at the dates we have agreed to in writing or in the portal.
  • Capture proof of placement (tear sheets, screenshots, affidavits, SWA confirmations) and store it against the case.
  • Maintain the platform with industry-standard security and uptime.

6. No legal advice; no guarantee of certification

PermAd360 is not a law firm, does not provide legal advice, and does not represent customers before the Department of Labor or any other government agency. Legal responsibility for the PERM case, the choice of recruitment steps, and the determination of lawful applicant rejection reasons remains with the customer’s immigration counsel. No platform or agency can guarantee DOL approval. Our role is to ensure structured, documented, compliant advertising that supports the strongest possible application.

7. Fees and payment

Fees are itemized per case and per channel in the invoice issued through the portal. Payment terms are net 30 days from invoice date unless otherwise agreed in writing. We may suspend service for accounts more than 60 days past due.

8. Refunds

Once an advertisement has been placed with a vendor, the vendor cost is generally non-refundable. Where a placement has not yet run and can be cancelled with the vendor, we will refund the corresponding portion of the invoice less any agency fees actually incurred.

9. Data and confidentiality

Each party will treat the other’s confidential information as confidential. Our handling of personal data is described in the Privacy Policy.

10. Intellectual property

Customer retains all rights to the content it submits to the platform. PermAd360 retains all rights to the platform itself, including the workflow software, the AI abbreviation system, the proof-package generator, and any aggregated, anonymized usage analytics.

11. Acceptable use

You will not use the platform to violate any applicable law, to misrepresent recruitment activity, to falsify advertising proofs, or to circumvent our security or access controls.

12. Warranty disclaimer; limitation of liability

The service is provided "as is" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. To the maximum extent permitted by law, PermAd360’s total liability for any claim arising from or related to the service is limited to the fees paid by the customer in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

13. Termination

Either party may terminate for material breach not cured within 30 days of written notice. Upon termination, the customer remains liable for unpaid fees and for the cost of any advertisements already placed with vendors on the customer’s behalf.

14. Changes

We may update these Terms from time to time. Material changes will be notified to active customers by email or in-app notice at least 30 days before they take effect.

15. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in New Jersey.
